To-Deed Trust
Daniel West I J.S. Pipkin have this day bargained and sold and do hereby convey to
Daniel West for the sum of five dollars tome in hand paid the receipt I have acknowledged
and the consideration hereafter mentioned. One stable horse name is Dick Johnson, and one
mare and colt, and one yoke of oxens the above now in my possession. To have and to hold
the same property to the said Daniel West his heirs and assigns forever. I covenant with
said West that I am lawfully possessed of said property and have a right to convey the
same and that the same is unencumbered. I do\further covenant and bind myself my heirs and
representatives to warrant the title to said property against the lawful claims of all
persons whatsoever. But this deed is made for the following uses & trust and for no other
purpose that is to say I am indebted to one note given to R.C. Dockins for one hundred and
eighty dollars Thomas Watt as my security now due also on note made to William Roberts
one note about a hundred and forty five dollars with Daniel West my security now due. Also
one note made to J.W. Pickler for one hundred and thirty one dollars and now due Daniel
West my stayor. Also one note given to Franklin Bousle for one hundred and twenty one
dollars due the first of January 1861 with P.M. Brogden and W.R. Rooks my security and I
am to secure and make certain the payment of the same. Now if I should pay the same debt
by the twenty fifth of August 1861 then this deed to be void but if I should not then this
deed to remain in full force and after the said Daniel West as Trustee as aforesaid after
giving ten days notice in writing at three public places in District 1 may expose the said
property to public sale and sell it to the highest bidder for cash in hand and appropriate
the same first to the expenses and secondly to the payment of the aforesaid debts and
remainder if there should be any to hand to me this 26th of August 1860.
