Last Will & Testament
Set up and established
April Term 1851 (7?)

In the name of God, Amen I Sidney Foshee of the County of Dyer and State of Tennessee
being of sound mind and memory but mindful of the certainty of death and the uncertainty
of life do hearby make ordain and constitute this my last will and testament revoking all
others heretofore by me made.

Item 1st. I will and bequeath my spirit unto God who gave it my body to the earth to be
decently buried.

Iten 2nd. I direct all of my just debts to be paid as soon as possible and after the
payment of my debts as before mentioned. I will and bequeath to my beloved wife Mary
Ann Meldrin (transriber note: or Meldria) Fochee during her natural life or widowhood
all of my personal and real estate to be disposed of as she pleases.

Item 3rd. At the death of my wife I direct my state to be equally divided between my
children to wit. William Lya, Thos. Vaughan, Mary Hays, George Washington, Joseph
Perryman, Jno. Henry and any other my wife may bear within nine months from and after
my death.

Item 4th. At the marriage of my wife I direct that my estate be equally divided between
my children and wife.

Item 5th. I hereby nominate and appoint my friend James Powell Executor of this my
last will & testament. In testimony of all which I do hereunto set my hand and seal
this 13 May 1852.
