Last Will
&
Testament
Proven and set up at the
September Term 1855
In the Name of God Amen.
I, BURRELL ROBERTSON of the County of Dyer and State of Tennessee being of sound mind and memory and considering the uncertainly of this frail and transitory life do therefore make and ordain publish and declare this to be my last will and testament, that is to say
First; I lend to my beloved wife during her widowhood one hundred & sixty two acres of Land; and should she marry then, she to have one third of the same during her natural life it being all of my tract of land lying west of the Road, and two acres in the North West corner of the tract lying East of the Road.
Secondly; I give and bequeath to my wife two cows and calves, Four sows and pigs one black Mare, Fifteen Hundred lbs. of Pork Fifty Barrels of corn Forty bushels of wheat. Four stacks of Fodder if saved upon the place all my house hold and kitchen furniture Three Plows and Gear and twenty five Dollars in cash.
Thirdly, I loan to my wife one sorrel mare colt till my son WILLIAM ROBINSON is Twenty one years of age, then I give said mare to him.
Fourthly; I also give my wife Ten Shoats.
Fifthly; I leave the Fifty acres of land East of the Road to be sold $250 of the purchase money to be paid; the balance on a credit of one, two, three and four years. I also have all my pork hogs to stay on the place till they are fat and then sold as my Executor may think best and I leave all the residue of my estate both Real & personal to be sold and my debts paid; and the residue to be put at interest and the interest to be expended in schooling my children.
Sixthly; I give to my Daughter CENELOPE SWAIN her portion of said money when collected and my estate settled.
Seventhly; At my wifes death I leave the above 16 acres of land to be sold on a credit of one two and three years, and of the proceeds of the same, I give to my son WILLIAM ROBINSON $25 and to my son BURWELL ROBINSON $75 and to my daughter LUCINTHA ROBINSON $40 and to my daughter HARRIET ROBINSON $100 and to my son STEPHEN ROBINSON $100 The residue to be equeally divided among my six children "Viz" PENNELOPE WILLIAM LUCINTHA; BURWELL, HARRIET; & STEPHEN likewise I make constitute and appoint ROBERT JOHNSON to be Executor of this my last will & testament, hereby revoking all former wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal this 4th day of June 1855.

This day a paper writing purporting to be the last will and testament of BURWELL ROBINSON deceased was produced here into open Court, and J. L. FARMER and G. F. PERRY the subscribing witnesses thereto were called here into open court, and after being duly sworn depose and say that they were personally acquainted with the Testator and that he signed and published said will in their presence on the same day it bears date and that they witnessed the same in his presence at his request and that he was of sound and disposing memory at the time of making said will to the best of their knowledge and belief.
It is therefore ordered by the court that said paper writing be set up as the last will & testament of said BURWELL ROBINSON & to be Recorded.
