Will of JOHN PAYNE

Will and Testament
27 Feb. 1855
I, John Payne of the County of Dyer, Tennessee, being sick of body, but sound of
mind and memory make this my last Will and Testament.
First:- To MARY RUSSELL, deceased, NANCY EDNEY, WILLIAM PAYNE, THOS.
PAYNE, JOHN PAYNE JR., MARTHA RUCKER, SUASAN BECAEN (Bowen?)
EMILINE GENTRY, ROBERT PAYNE. I have given their proportion of all my
Estate, all the balance of my Estate I give and bequeath to my beloved wife SUSAN
PAYNE to have and hold the same during her natural life or widowhood and at the time of
her death or marriage.
Second:- I will that all my remaining Estate be divided among my last children as
follows: GEORGE PAYNE, LUCINDA SHELTON, ELIZABETH ADCOX,
BURTON PAYNE and AMERICA PAYNE.
Third:- I will that at the marriage of my last two children that my wife SUSAN PAYNE
give to said two children the same amount that I have given to the last children.
Fourth:- I will that one hundred dollars be given to MARTHA RUCKER'S children
to be appropriated towards their education.
Fifth:- I also will that two hundred dollars be given to BURTON PAYNE in
consequence of his having no education.
Sixth:- I will that after said appropriated be made, the remaining portion of my estate
be equally divided between the GEORGE PAYNE, LUCINDA SHELTON,
ELIZABETH ADCOX, BURTON PAYNE and AMERICA PAYNE, and I hereby
appoint NELSON PARRISH sole Executor of this last Will and Testament hereby
provoking all former Wills by me.
Signed with my hand and seal this day and date above mentioned.
