Last Will & Testament
Proven and set up at
the September Term 1859
Recorded September 1859

In the Name of God Amen.

I ELIZABETH HODGE of the County of Dyer and State of Tennessee being of sound and disposing mind and memory but calling to recollection the mortality of the body do make and constitute and ordain this my last will and testament revoking all others by me at any time made. In the first place I comment my soul to God who gave it; and my body I commit to the earth to be buried in a decent christian like manner, and that my burial expenses together with all my lawful debts (if any) be paid as early after my death as possible. In the next place I give and bequeath unto my nephew NELSON ALLEN the tract of land on which I now reside containing by estimate one hundred and seventy five acres to him his heirs and assigns forever. I also give and bequeath unto the said NELSON ALLEN the following negroes, to wit, one negro man named HARRY, one old negro, woman named RACHEL, one negro man named WILLIAM, one negro man named ARON, one negro boy named MATTHEW, and one other negro woman named RACHEL and her child named TENNESSEE to be hers [his?] forever. I further give and bequeath unto the said NELTON ALLEN my waggon, and six choice head of horses if there be that many further I give and bequeath unto the said NELSON ALLEN thirty five head of the choice of my hogs if there be that many. I further give and bequeath unto the said NELSON ALLEN two large feather beds and Bedsteads and furniture, and one small bed and Bedstead and furniture, also one Bureau one sugar chest one Dinning Table One side Board, one candle Stand one clock, one dozen chairs and all my cupboard ware and all my cooking utensils and milk vessels and wash tubs and water pails, also two looking glasses. In the next place I give until GEORGE MURRY the son of my niece SARAY ANN MURRY dec'd. four hundred acres apart of a League of Land which I am possessed of in the Counties of McClennon and Bell and State of Texas. I also give unto ELIZABETH ANN MURRY the daughter of my said niece SARAH ANN MURRY dec'd four hundred acres of land out of the above named League of Land. If either of the above mentioned children should die before arriving to the age of twenty one years or before marrying, I leave it all to the surviving one. In case they should both die before marrying or arriving at the age of twenty one years then and in that case I give & bequeath the above mentioned land to my sister McDANELLS children to be equeally divided among the living heirs. I give and bequeath to my nephew AUSTIN STANLEY Three hundred acres of Land out of the above mentioned League. I give and bequeath unto GEORGE A. STANLEY son of my nephew AUSTIN STANLEY Three hundred acres of land out of the said above mentioned League; to be theirs forever. I give and bequeath six hundred acres of the above mentioned League of Land to living children of my sister McDANELL to be equeally divided amongst them forever; the balance of the above mentioned League of Land I leave to be sold to be applied to my Executors to any incidental expences that may occur. I further give and bequeath unto my nephew NELSON ALLEN all my farming tools and Barouch. It is further my will and desire that should there be any property or money belonging to or due my estate which I have not above disposed of in this will that it be equeally divided between GEORGE MURRY and ELIZABETH ANN MURRY children of my niece SARAH ANN MURRY dec'd forever to be paid over to them by my Executor. I nominate and appoint, my nephew NELSON ALLEN and ALFRED TO. FIELDS my Executors to this my last will and testament. In witness whereof I have here to set my hand and seal this day of June A. D. 1857
