Last Will & Testament of JOSEPH ELLIS Dec'd Proven and Established at the June Term County Court 1863 In the Name of Almighty God Amen. I JOSEPH W. ELLIS of the County of Dyer and State of Tennessee being of sound body and mind but concious of the uncertainty of life and the certainty of death do make and publish this my last will and testament hereby revoking all others heretofore made by me That is to say. Item 1st At my death I wish my Body to be decently buried, and all of my debts discharged as soon as possible by my Executor heretofore to be appointed. 2nd I give and bequeath unto my beloved wife the one third in value of all my real estate including the House wherein I now live. I also give and bequeath to her an equal share of my personal property to be divided between her and my children hereinafter named. The Real Estate She is to hold for and during her natrual life and then the same is to be disposed of as I may hereinafter direct. Item 2nd (should be 3rd) I give and bequeath unto, my children NANCY ELLIS, ALMEDIA ELLIS, MARGARETT EVELINE ELLIS, CHARLOTTE GREENE ELLIS, RICHARD ETHALARY ELLIS, MANDY P. ELLIS, WILLIAM W. ELLIS, GEORGE WASHINGTON ELLIS, all of my property both real and personal to be divided between them as soon after my death as practiceable my children to whom shall be alloted the land in which my wife has a dower interest shall take possession of the same on her death. To my children DAVID T. ELLIS, MARTHA A. SEALS; WILLIAM H. ELLIS and FRANCIS J. ELLIS I give and bequeath the sum of One Dollar each, they having failed to discharge the duties of children to a parent. I hereby nominate and appoint CHARLES H. LEDSINGER Executor of this my last will and Testament. In Testimony whereof I have hereunto set my hand and affixed my seal the 30th day of November 1861. JOSEPH W. (X) ELLIS
