Last Will & Testament of JOSEPH W. ECHOLS dec'd Set up September Term 1867 I, J. W. ECHOLS of the county of Dyer and State of Tennessee do make and constitute the following to be my last will when I shall happen to die - that is to say I had the following named brother and Sisters Some of whom are now dead BENJAMIN F. ECHOLS, ELIZABETH DEPOYSTER, NANCY _____, SARAH J. CLEMENTS and MARY ANN LEEROY - but as Seven of them have not treated me well I am desirous that whatever property and effects that I may leave at my death after my just debts are paid shall be distributed as follows that is I will and bequeath to my Sister NANCY all of the land Town lots &c that I own in the State of Illinois Two hundred and twenty acres of land on which B. M. CLANAHAN now has a lease, and to my niece little MARY ANN LEEROY, I give and bequeath my negroes and all that remains belonging to me both personal and real and I desire that when I shall happen to die that my Mercantile business be at once wound up - that there be no more goods purchased and the whole matter at once settled up. Witness my hand and seal this 10 day of November A.D. 1860 J. W. ECHOLS (Seal) State of Tennessee Dyer County April 13 1865 I J. W. ECHOLS of said county and state being still living and of disposing mind do on account of certain changes in the disposition of my worldly effects after my Death shall have happened - That is to say I now wish to give and bequeath to my niece MARY ANN LEEROY now MARY ANN YEARGIN the House and lot that I lately purchased from WM. C. DOYLE and my negro woman named ELIZA and all her children that she now has or may hereafter have - and to my Sister MARY ANN LEEROY I give and bequeath all my land and other negroes and personal effects of all and every Kind that I own or possess in the State of Tennessee except as above stated - and my sister NANCY ____ her heirs and assigns all my property in Illinois as originally Stated in the within Testament. Given under my hand and seal this day above written J. M. ECHOLS
Attest: State of Tennessee Dyer County June 5th 1866 I J. W. ECHOLS do hereby authorise and empower my sister MARY ANN LEEROY to Execute and Administer my whole estate without giving any Security Witness my hand and seal the day and year June 5, 1866 J. W. ECHOLS (Seal)
Attest: I still desire my Sister MARY ANN LEEROY to have all that I have above bequeathed to her and all the land I may Since acquire and all personalties aquired before or Since or that may ___ to me hereafter this 7th day of August 1867 J. W. ECHOLS
