February & March Term of the
County Court of Dyer County 1862

January 12 in the year of Our Lord 1862

State of Tennessee
Dyer County

I DAVID BAIRD being sound in mind and of disposing Memory, make this my Last will and Testament, revoking all other wills -

First: I desire that all my just debts be paid including funeral expenses.

2nd I will to my wife MARY BAIRD Fifty & one half acres land, on the North end of my tract of land, including the houses, during her Natural life - also my negro man JOSEPH and PATSY (a woman) - with all the house hold and Kitchen furniture - to hold the same during her natural life - also all the stock, with every thing belonging to the farm.

I will to my daughter REBECCA a Town lot in Newbern to have for her separate and individual use, Separate and apart from her husband, to hold as her own property and to dispose of as she may see fit - valued at Five hundred and fifty dollars - Whatever else may be coming, if any in a final division, to go jointly to my daughter REBECCA and her husband A. JONES.

I here to fore have given my daughter MARTHA BAIRD a full share of my estate - consequently make no further provision for her in this will -

I will to my son WILLIAM the parcel of land as his absolutely after the death of my wife MARY what I willed her during her natural life for which is 50 1/2 acres for my son WILLIAM to hold finally as his, to all intents and purposes - which is his entire interest in my estate, Except the negro boy JOE -

I will to my three daughters, to wit: REBECCA, MARY and ELIZABETH the Southern half of my tract of land 50 1/2 acres - (I value this land at $1,500) to be equally divided among them, as they may see fit to divide the same.

I also will to my daughter ELIZABETH my negro girl ELIZA - valued at $550.

I further bequeath to my daughter MARY a promisory note I hold against the Estate of her dec'd husband - for about $200 Dollars - also enough of the assets of my estate to make her equal to REBECCA, ELIZABETH and to my son ANDREW R. BAIRD -

I have already given my son A. B. BAIRD Eleven Hundred and ten dollars, for which I hold his receipt -

I further desire that my wife have every thing now on the farm, such as corn, meat, hogs, cattle, horses wagon, buggy &c &c - My general bequest is that my son A. R. BAIRD, MARY W. REBECCA & ELIZABETH be made equal by the sale of my mountain land in Middle Tennessee after the death of my wife -

I desire at the death of my wife MARY that JOE and PATSY be sold Privately and the effects be equally divided among and between my 2 Sons and 3 daughters to wit: REBECA, MARY, A. R., WILLIAM and ELIZABETH. -

I appoint my son J. W. BAIRD my Executor without giving bond or Security
