S. P. Williamson To Deed Trust WB Sampson Rec'd Jany 12th 1874 At 2 1/2 o'clock PM For the consideration of One dollar to me in hand have the receipt of which is hereby acknowledged. I have this day bargained and sold and do by these presents alien transfer and convey unto WB Sampson and his heirs forever in fee simple the following dis??ed tract or parcel of land in the 10th Civil District of Dyer County Tennessee and bounded as follows to wit beginning 20 poles west of the northeast corner of the JF Blount 1000 acres runs thence north 60 poles to MC Carney's line thence west to MC Carney's southwest corner thence West and South to Blounts north line & thence East to the Beginning containing by estimation thereto belonging or in any wise ascertaining. In testimony where of I have hereunto set my hand this 12th Janary 1874. But this foregoing conveyance is made for the following uses & purposes and none other that is today. I transfer and convey to said WB Sampson a certain tract of 30 acres of land by deed on the * day of 187* for the consideration in said deed sorting said 30 acres tract of land being the land inherited by me from the Estate of my Father DJ Williamson Dec & bounded on the north by the home place of WH Benton on the east by the lands of (Home Place) of Mrs Mary Simmons on the south by the hom place of LP Williamson and on the west by the home place of WH Raalk and whereas the title to said 30 acres tract of land is insolved in the caused in the chancery Court of Dyer County Tennessee of HB Folkes vs JH Purcell et als to which said suit I am a party Now therefore if said land in said suit should be adjusted liable for the payment of any sum of money and shall be sold by which sale the said WB Sampson may become losen by reason of the failure of Title in him by virtue of said deed to him then said WD Sampson shall expose to public sale the property therein conveyed (after advertising the same by printed hand bills only for 30 days) at the court house door in Dyersburg Tenn for cash to the highest bidder & the proceeds of said sale apply first to the payment of the cost of executing this trust and to making good any losses he may suffer by reason of the sale of said 30 acres tract of land or any loss he may suffer by reason of being compelled to pay any sum of money to prevent the sale of said land and I hereby expressly waive any right of redemption in repurchase ??? in and for myself or in and for my heirs & assigns forever and I hereby waive the necessity of my said trustee (WB Sampson) Bounding or taking any oath or said trustee and shall there be any surplus after applying the purchase money of this land incase of sale as set forth above my said trustee shall said proceed secondly to payment to me or my order if said then this conveyance to be void given under my hand this day and date first above written.
