D. J. Williamson To Deed Trust 35 WC Doyle Rec'd Apr. 18th 1873 At 1 1/2 oclock PM For the consideration of One dollar to me in hand paid by W. C. Doyle the receipt of which is hereby acknowledged and the other consideration herein after named DJ Williamson of the county of Dyer County Tennessee have this this day bargained & sold and hereby transfer and convey unto the said WC Doyle his heirs and assign the following tract of land in the 4th Civil district of Dyer County Tennessee it being the same allotted to me in the division of the late DJ Williamson land and is bounded as follows to wit beginning at a stake the S. E. corner of the original Williamson tract running thence north 54 1/8 poles to a stake with mulberry oak and Persimmon pointers thence west 116 1/6 poles to a stake the north east corner of SB Williamson 25 acres thence south with his line 54 1/8 poles to a stake with Sweet Gumm maple and small persimmon pointers his southeast corner thence East 116 1/6 poles to the beginning containing by estimation 35 acres and twenty three poles be the same more or less. Together with all the improvements thereon or in any wise ascertaining there to have and to hold the same unto him the said Doyle his heirs and assigns that I am lawfully severed of said land and bargained premises have a good sight to convey it and that the same is now unencumbered and that I and my heirs and parcel thereof unto him the said WC Doyle his heirs and assigns against the lawful claims of all persons whatsoever. But this conveyance is made for the following uses and Trust & for no other I am indebted to the said WC Doyle by note of this date due the 1st day of January 1874 for the sum of Two Hundred Six Dollars and Eighty cents with 10 percent interest of ten Maturity and the said WC Doyle has also my security to Stevens & Brothers for balance of debt I owe them and for the securing of which I did execute a Deed of Trust to them on or about the 22nd day of January 1872. Now I desire to secure the payment of said note of $286.80 and to secure said Doyle free from loss by reason of his bargaining my security to said Stevens & Brothers And if I pay said note of $286.80 and the balance of said Stevens & Brothers debt on or before the first day of January, 1874 than this conveyance she be void and for nothing held but if I fail to pay said debt or either of them aforesaid there the said WC Doyle (or in the event of his death or other disability) the John Sciffington is hereby authorized to act as trustee and is clothed by these presents with full power and authority to his trust and either said Doyle or Skiffington without rath or bond may sell said land after advertising by written appointed hand bills posted at three public places in Dyer County and sell the same at public out cry at the court house door in the town of Dyersburg for cash in hand and out of the proceeds of said sale he shall pay the cost of conveyance then pay said note & interest and pay sum the said Doyle may have to pay Stevens & Brothers for me and the balance pay to me or my order and if the land herein conveyed should have to be sold to pay debts herein described then I hereby express by waive the equity of redemption and said sale shall be absolute and convey a good title to the purchaser. In Testimony whereof I have hereunto set my hand and seal this 17th day of April 1873.
