May 24th 1871 at 11 oclock AM For and in consideration of one dollar to me paid and the other considerations herein after mentioned I DJ Williamson of Syer County Tennessee have bargained and sold & do hereby these presents alien transfer convey & confirm unto HC Armstrong of the same County the following tract of Land or parcel situated in the Fourth Civil district of Dyer County Tennessee about one mile Northwest from Dyersburg bounded as follows Beginning at a stake the south East corner of the DJ Williamson tract of Land & The North east corner of the FNW Benton tract on the west line of B McCullochs 800 acres running thence North 54 1/8 poles to a stake with mulberry ash & persimmon pointers Mary E. Simmons South east corner thence west 116 1/6 poles to a stake the northeast corner of LP Williamson 25 acres Thence south 54 1/8 poles to a stake with sweet gum maple & persimmon pointers LP Williamsons southeast corner Thence east 116 1/6 poles to the beginning containing by estimation Thirty five acres & ½ be the same more or less to have & to hold said land with the tenements hereditaments & appurtenances to the same belonging and appertaining to the only proper use & behoof of him the said HC Armstrong his heirs and assigns for ever & I covenant with the said HC Armstrong that I am lawfully seized in remainder of said land & have a good right to convey it to him & that the same is free from all incumbrances except My Mothers Dower estate therein but this conveyance is made for the following and no other purpose & trust that is to say I am indebted to the said HC Armstrong in the sum of $ 536 73/100 evidenced by note this day dated & due seven months after date with interest at ten percentum from this date and in the further sum of $ 265 50/100 evidenced by note dated this date & due seven months after date with interest at ten percentum per anum after maturity. Now if I shall pay off both both said debts and all interest & cost thereon by or before the first day [Page 296] Of January next then this conveyance shall be void & of no effect but if I fail to pay off said two debts & costs by that time then said HC Armstrong trustee shall on giving twenty days Notice by three or more written or printed hand bills sell my Interest in remainder in said tract of land at public auction for cash in han and apply the proceeds of said sale first to the payment of the costs of making and executing this trust secondly to the payment said two notes Debts and Interest and cost so much thereof as shall remain unpaid and the remainder if any pay to me or my order said Armstrong is execused from giving bond & filing affidavit to execute this trust Witness my hand & seal this 24th day of May 1871 Witness James W Ledbetter DJ Williamson {Seal} FG Sampson State of Tennessee Dyer County} Personally appeared before me Will Watkins Clerk of the County Court of said County DJ Williamson the within named bargainor with whom I am personally acquainted and who acknowledged the execution of the within Deed of Trust for the purposes therein contained.
