CM SMITH To ) Bill Mortgage PAYNE, HURLEY & WELCH Reg. May 11, 1840 PETER L. FISHER Register I CHARLES M. SMITH of the county & State of Tennessee for and in consideration of the sum of One dollar to me in hand paid & the other consideration hereinafter set expressed hath bargained & sold and by this thes presents doth convey unto JOHN PAYNE, MOSES HURLEY & HENRY WELCH of the same County & state Two Negro boys one aged about fourteen years named LEWIS the other aged ten named PETER both SLAVES for life to have & to hold to the said JOHN PAYNE, MOSES HURLEY & HENRY WELCH their heirs and assigns forever. But this deed is upon the express condition that if I the said CHARLES M. SMITH shall well & truly pay a certain note for five hundred dollars made payable in the Branch of the Bank of Tennessee at Trenton which note was indorsed by the said PAYNE, HURLEY & WELCH when the same shall become due and shall keep the said PAYNE, HURLEY & WELCH from cost damage or expence in consequence of said indorsement then this deed to be void otherwise to be & remain in full force & virtue in law & equity. I witness wherof I the said CHARLES M. SMITH have hereunto set my hand and affixed my seal this third day of April 1840.
