For & in consideration of the sum of Five Dollars to me in hand paid for receipt whereof is hereby acknowledged I John R. Robbins of Dyer County Tennessee have bargained sold & granted and do by these presents grant bargain Sell & convey unto D J Williamson a certain tract or parcel of land lying in Dyer County part of 5000 acre Tract Granted to Butler, Phillips & McNairy and Bounded as follows – Beginning at a stake with Dogwood Poplar Sweet Gums and Black Gum pointers in the South West corner of Lot No 14 in the division of said original tract Thence South 150 poles to a Poplar with a Poplar & 2 Black Gum Pointers in the South boundary line of said original tract Thence East with said line 160 poles to a sweet gum with a sugar tree Ash & Horn beam pointers Thence North 150 Poles to a Stake Thence West 160 poles to the Beginning containing 150 acres more or less. To have and to hole the said Tract of Land with its appurtenances to the said D J Williamson is heirs & assigns forever.
And I do promise & covenant to & with the said Williamson his heirs & assigns for myself my heirs Executors, Administrators & assigns that I will warrant & forever defend the said tract of Land with its appurtenances against the lawful claims of all persons whatsoever.
But this conveyance is made for the following purposes to wit There is an execution issued from the Chancery Court at Nashville against me for between Seven Hundred and Eight Hundred Dollars which debt One E A Ferguson deceased in his lifetime became bound for at my request by executing his Bond of indemnity to William Dearmore. And I being unable to pay said debt at this time the same will have to be paid by the said Williamson as Administrator of said Ferguson and this conveyance is made to secure the said Williamson Administrator as Aforesaid in the payment of said debt. And to that end the said Williamson is hereby invested with full power as soon as it may be ascertained that I have a title decreed by said Court or as soon thereafter of said Williamson may think Proper to sell said Land at public Sale at the Court House door in Dyersburg – for cash after giving Thirty days Notice by Written Advertisements at the Court House door and at such other places in said County as Williamson may think proper and the proceeds of the sale he is to apply to paying the Costs of this conveyance and the satisfaction of said debt retaining the amount with interest which he may have paid if any and paying to whomsoever the same may due whatever may still remain unpaid and then of the proceeds of said sale shall be paid to me or if I shall pay the aforesaid sums of money without a sale of the Land then this conveyance to be void otherwise to remain in full force & virtued. In testimony of all which I have hereunto set my hand and seal this 12th day and February AD 1853.
