This Indenture made and entered into this 23rd day of November 1852 by and between Henderson Clark
of the County of Dyer and State of Tennessee of the one part and D.J. Williamson Trustee & of the the
County and State aforesaid of the Second Part Witnesseth That the said Henderson Clark for and in
Consideration of the sum of One thousand Dollars to him his heirs the receipt Whereof is hereby duly
acknowledged by the said Clark hath given granted bargained and sold unto the said D.J. Williamson is
heirs and assigns forever a certain tract piece or parcel of Land situated in the County of Dyer in the
Fourth Civil District & in the State of Tennessee and being the place wherein Z.B. Phillips now resides.
Beginning at the South West corner of a tract of Land purchased by P. T. A. Walker of Benj. McCulloch
(A Cherry Tree) and now owned by Pate & Wilson Running from thence East One Hundred and two
poles to a White Oak Standing in or near a Small Branch Thence South Seventy Nine Poles to a stake &
Pointers in the South boundary line of a 120 acre tract of land conveyed by ZB Phillips to the said Clark
Thence West One Hundred & two poles to the South East Corner of a tract of land purchased by E. A.
Ferguson of Benj. McCulloch Thence North to the Beginning – Containing by estimation Forty Five
Acres & 58 poles of Land including and excluding Three acres in the South East corner of the land
hereby conveyed and two acres lying immediately North of & adjoining the said three acres – To have
and to hold the said piece or parcel of land with all and singular the rights profits Emoluments &
appurtenances thereunto belonging or anywise appertaining to the said D. J. Williamson his heirs and
assigns forever – Upon trust for the following used and purposes and for no other to wit for the sole
separate use benefit and behoof of Mrs. Lucinda L. Phillips Wife of Z. B. Phillips and at the death of the
said Lucinda L. Phillips said ground & bargained premises to go to the said Z. B. Phillips if he shall be
there living but if he shall be dead then in equal proportions to the heirs of the said Lucinda L. Phillips
and Z. B. Phillips and D. J. Williamson as trustee as aforesaid may with the advice and consent of the said
Lucinda L. Phillips & Z. B. Phillips sell and convey said land and bargained premises and vest the
proceeds in other property for the sole and separate use of the said Lucinda L. Phillips and free from the
control of her said Husband in like manner as before Set forth herein and the said Lucinda L. Phillips
shall hold occupancy and enjoy hold at her Election said property and take and receive the vests and
profits to her sole & Separate use free from the Controls of her said Husband as aforesaid – And the said
Henderson Clark for himself his heirs Executors or Administrators doth Covenant & agree to and with
the said D. J. Williamson his heirs and assigns in trust as aforesaid that the title of the before recited
property and bargained premises he will warrant & forever defend against the lawful claim of all persons
Whatever – In Witness whereof the said Henderson Clark hath hereunto set his hand and seal the day and
year first above written.

County H. Clark the within named bargainor with whom I am personally acquainted and acknowledged
the execution of the foregoing deed of conveyance for the purposes therein contained. Witness my hand
at office this Sept 5th AD 1854.
