Abner Benton and Others To – Title Bond Henry Folkes Registered November 2, 1844 A. G. Ferguson Regr D. C. Know all men these presents that I Abner Benton and Jno Rowlete1 D. I. Williamson 2 and John P. Byrne all of Dyer County and State of Tennessee are held and firmly bound unto Henry Fowlkes in the Penal sum of one thousand dollars for which well and truly to be paid we bind ourselves our heirs executors administrators and assigns jointly severally and firmly by these presents the condition of the above obligation is such that whereas Sd Henry Fowlkes has this day purchased of Abner Benton Nathal Benton Thomas H. Benton Jr a Minor by his Guardian Abner Benton and of Robert D. Boggus and Susan his wife a certain tract of land owned by said parties as tenants in common, lying in Dyer County and contains by estimation five hundred and nineteen and a half acres being part of a five thousand acre tract granted to the heirs of Jesse Benton and that part which by a decree of the circuit Court of Dyer at the October terms A. D. 1844 was allotted and portioned to Sd Boggus and wife and the Sd Thomas H. Benton Jr and to Rufus Benton and Marcenas Benton in division between them and John Branch and Thomas Hane in said Court said tract of land being owned by the parties aforesaid in the following proportion to wit: Abner Benton and Nathaniel Benton owning each sixty four and five eighths acres and said Boggus and wife and Thomas H. Benton Jr owning each one hundred and ninety four and five eighths acres said land being purchased by said Fowlkes for 500 dollars in hand paid and the further sum of five hundred to be paid one year from date. And whereas deeds of conveyances can only be obtained for the interest of said Nathaniel & Abner Benton said Buggus and wife being in Arkansas and said Thomas H. Benton Jr being a minor under the age of twenty one years. Now therefore if said Abner Benton shall procure or cause to be procured deeds of conveyance for the other interest in said tract of land to wit The interest of said Boggus and wife and of Thomas H. Benton duly executed for registration according to the laws of Tennessee with Covenants of general warranty conveying said land to said Fowlkes in fee simple and where such deed or deeds duly registered in the registrars office of Dyer County on or before the 1st Day of November A. D. 1845 and if said A. Benton shall cause and procure said Fowlkes to placed in quiet and peaceable possession of said land on or before the 1st day of March 1845 then this obligation to be void otherwise remain in full force and virtue.
