B. T. Horton and Wife
This indenture made this 9th day of October 1899 between B. T. Horton and M.
E. Horton his wife of the county of Dyer and State of Tennessee of the one
part, and J. T. Alsup of the county of Dyer and State of Tennessee, of the
other part, witnesseth that the said B. T. Horton & wife M. E. Horton his
wife for and in consideration of Two Hundred Dollars cash, Two Hundred
dollars due Nov. 15/1900 and two Hundred dollars due Nov. 15/1901 last two
payments evidenced by Notes of even date herewith and bearing 6% interest
from date to B. T. Horton in hand paid by the said J. T. Alsup the receipt
whereof is hereby acknowledged hereby sells and conveys unto the said J. T.
Alsup his heirs and assigns forever a certain piece or parcel of lands
situated and being in the County of Dyer State of Tennessee and in the 10th
Civil District of said County and bounded as follows: Beginning at a stake
with Maple white oak and gum pointers, G. J. Pritchett North West corner
runs thence west 187 poles to a stake: thence South 140 poles to a stake J.
M. Whittington's North west corner: thence East 187 poles to a stake with
Maple and two sweet gum and ash pointers: thence North 140 poles to the
Beginning. Containing 163 1/3 acres, including and excluding 25 acres sold
by Turner Chamberlin to T. J. Pritchett being the East end of above
described land, to have and to hold the aforesaid land, with all and
singular the hereditaments and appurtenances of and to the same belonging or
in . . . use appearing to the said J. T. Alsup his heirs and assigns
forever, and the said B. T. Horton and his wife M. E. Horton for their heirs
and representatives do covenant and agree to and with said J. T. Alsup his
heirs or assigns that they are lawfully seized in fee of the afore granted
premises: that the same are free from all encumbrances and that hey have a
good right to sell and convey the same to J. T. Alsup as afore said: and
that the before granted land and premises they will warrant and forever
defend against all lawful claims whatsoever. A special lien is hereby
retained on the within described tract of land to secure the payment of the
two notes above described. In witness whereof the said B. T. Horton and his
wife M. E. Horton have hereto set their hands and affixed their seals the
day and year above written.
