R. C. Allen To} Deed of Trust D. J. Williamson Registered June 12, 1852 Stephen D. Whitten RDC This Indenture made this 11th day of June in the year A. D. 1852 Between RC Allen of the one part and DJ Williamson of the other part Both of the County of Dyer and State of Tennessee Witnesseth That the said RC Allen for and in consideration of the sum of Five Hundred Dollars to him in hand paid by the said DJ Williamson the receipt whereof is hereby acknowledged hath given grantee bargained & sold and by these presents doth give grant bargain and sell convey and confirm unto the said DJ Williamson his heirs and assigns forever the following described property To wit one Press one Fether Bed & furniture & one Bed stead one breakfast Table one Dress Table one candle stand Two Trunks one Looking Glass one clock and one cook stove To have and to hold the said above described property with all and singular the writes thereto belonging or in any wise assertaining to him the said DJ Williamson his heirs & assigns to his & their only proper use benefit and behoof forever. This conveyance is nevertheless made in Trust and for the uses and purposes herein after mentioned and declared and none other that is to say whereas the said RC Allen if Justly indebted to Z.B. Phillips in the sum of One Hundred Dollars By Note dated the 18th day of Jany 1852 and due and payable the 19th day of Jany 1852 and is also indebted to divers other persons to an amount greater as he apprehends than he will be able to pay and being anxious to secure the said ZB Phillips in the payment of his debt in Preference to his other creditors now therefore This indenture Witnesseth that in case the said RC Allen shall well and truly pay and satisfy the debt herein before mentioned on or before the 1st day of January dext then this conveyance to be void and of no effect otherwise the said DJ Williamson shall take possession of the property hereby conveyed and after giving Ten days Notice of the time and place at Three or more public places in Said County shall expose the same to sale to the highest bidder for cash and for after having first paid the expense of such sale and the other expenses attending the execution of this trust shall pay over the balance if any of said proceeds remaining in his hands after paying off said debt he shall pay over the said RC Allen or to his order It is expressly understood and agreed by the parties that until default be made in the payment of said sum of money the said RC Allen is to remain in peaceable and undisturbed possession an enjoyment of the property herein before mentioned and conveyed In Witness whereof the said RC Allen hath hereto set his hand and seal the day and year above written.
