JAMES JACKSON by his next friend and Guardian WILLIAM MILLER Be it remembered that on this 2nd day of August 1852, came on this cause for hearing before the Worshipful County Court of Dyer County on the Exparte Petition and proof. When it appeared to the satisfaction of the court that L.E. JACKSON departed this life in the year of 1846 intestate in Dyer County, that his personal estate has been settled up and his debt paid, that he left his two minor children SARAH ISABELLA JACKSON, who has since intermarried with JOEL PEEL and JAMES JACKSON his only heirs, that he left a widow MRS. JANE JACKSON who is entitled to a dower of his lands, that he left the following tract of land in the 3rd Civil District of Dyer County, Tennessee in the 7th Range and 2nd Section bounded as follows to wit; Beginning at RUTHERFORDS North East Corner, on the CORBETTS West boundary line; running thence North 130 Poles to an Elm and Dogwood saplings; Thence West 128 Poles to an Elm. Thence South 130 poles to RUTHERFORDS North boundary line; Thence East with his line 128 poles to the Beginning- containing ninety two acres. It further appeared to the court that said land cannot be divided to advantage, and that a Sale of the Tract of land is manifestly for the advantage of all the parties, especially the minor JAMES JACKSON. It is therefore ordered, adjudged and decreed by the Court that said land be sold- That WILLIAM MILLER be appointed Commissioner, that he sell said land privately if he can for its value, before the next term of this court. That the land be sold subject to the widow's right of dower, that said commissioner sell the same on a credit of one and two years, taking notes with approved security for the purchase money bearing interest from the date of sale, and report his proceedings herein to the next term of this court, until the coming in of which report all other matters are reserved? Whereupon the parties waive the necessity of the Commissioner giving bond to account for proceed of said sale.
