Dyer County Court Clerk Minutes

Dated March 3, 1851


Be it Remembered that a County Court was begun and held at the Court House in the Town of Dyersburg on the first Monday (it being the 3rd day) of March in the year of our Lord One Thousand Eight Hundred & fifty one, and in the Seventy-fifth year of the Independence of the United States of America.

Present and holding said Court the Worshipful SAMUEL McDAVID Esqr Chairman THOMAS J. CONNELL and ALEXANDER B. STALLCUP, quorum, WILLIAM MILLER, H. N. JACKSON, SAMUEL G. GILLESPIE, ISAAC SAWYER, HENRY WYNNE, Justices; WILLIAM A. DAWSON Sheriff of Dyer County and JAMES H. DOYLE Clerk of said Court, by his lawfully appointed Deputy FRANCIS G. SAMPSON, when and where, after Proclamation in the usual form, the following proceedings were had, towit:


MARY DAVIS, TURNER SHEARIN,
HENRY SHEARIN, JOSEPH SHEARIN,
and MILLS EASON & SARAH his wife,
JARED SHEARIN, HARRIET SHEARIN,
MALISSA SHEARIN, FRANCIS SHEARIN,
JANE SHEARIN and THOS. SHEARIN,
heirs of WILLIAM SHEARIN deceased,
the last six of whom are minors &
petition by their next friend TURNER SHEARIN

Ex Parte
Petition for the division of the slaves
belonging to the Estate of
HUGH N. SHEARIN decd.

This day came on this cause for further and final hearing on the coming in of the Report of the Commissioners appointed at the last Term of this Court to divide the slaves into five lots, and allot them among the several Petitioners...

To the Worshipful County Court of Dyer County, we the undersigned Commissioners appointed by your Worshipful Court at its February Term 1851, to allot and divide the slaves belonging to the Estate of HUGH N. SHEARIN decd to and among his heirs and disributees, respectfully report:... towit: 1st To the heirs of WILLIAM SHEARIN, decd. towit, MILLS EASON & SARAH his wife, WILLIAM REVEL & MARY his wife, JARED SHEARIN, HARRIET SHEARIN, MALISSA SHEARIN, FRANCIS SHEARIN, JANE SHEARIN and THOMAS SHEARIN, we have allotted and given Lot No. 1; towit, NONNAN [Norman?] a boy aged 15 years valued at $700., and FANNY a girl 11 years of age valued at $400. and they are to receive from JOSEPH SHEARIN $70. and from HENRY SHEARIN $10. making in all to them jointly $1180. 2nd to HENRY SHEARIN we have allotted and given Lot No. 2, towit, the Boy WESLEY 10 years of age valued at $600. and the Girl MYRA 13 years of age valued at $600. and he is to pay to the heirs of WILLIAM SHEARIN decd $10. and to MRS. MARY DAVIS $10. making in all to his share $1180. 3rd MRS. MARY DAVIS (the Mother) we have allotted and given Lot No. 3 to towit, the man ANDREW 30 years of age valued at $750 and the Girl AMELIA 9 years of age valued at $400. and she is to receive from HENRY SHEARIN $10. and from TURNER SHEARIN $20. making in all to her share $1180. 4th to TURNER SHEARIN we have allotted and given Lot No. 4 towit, the Boy SOLOMON 18 years of age valued at $900. and the Girl RASITY [Rarity?] 4 years of age valued at $300. and he is to pay to MRS. MARY DAVIS $20. in all $1180. 5th to JOSEPH SHEARIN we have allotted and given Lot No. 5 towit, the woman SARILDA 39 years of age valued at $500., the girl MARGARET 11 years of age valued at $550. and the boy JOHN 3 years of age valued at $200. and he is to pay to the heirs of WILLIAM SHEARIN decd $70. making in all $1180. All of which we respectfully submit to your Worshipful body for confirmation, under our several hands and seals this 7th day of February 1851.


This day HENRY BRANCH FOWLKES was chosen and appointed Guardian of his minor son CHARLES MATTHEW FOWLKES. Whereupon came the said HENRY BRANCH FOWLKES into open Court here together with THOMAS H. FOWLK & R. H. McGAUGHEY his securities and entered into and acknowledged Bond in the sum of Five Thousand dollars...


This day FRANCIS G. SAMPSON was chosen and appointed Guardian of THOMAS H. EARLE and JOSEPHINE EARLE minor heirs of WILLIAM H. EARLE late of said County deceased... with THOMAS J. CONNELL his security...


This day THOMAS H. FOWLKES Executor of WILLIAM SMITH deceased returned here into Court an Inventory and Account of Sales of said Estate and a Supplemental inventory and Account of the hiring of the slaves of said Estate, both which were received by the Court and ordered to be recorded.


It appearing to the Court that STEPHEN D. PATE, late of this County had departed this life leaving no Will; WILLIAM MILLER was appointed administrator of the goods and chattles, rights and credits of the said STEPHEN D. PATE... together with WILLIAM A. DAWSON and THOMAS J. CONNELL his securities...


This day ROBERT JOHNSON, WILLIAM B. FIELDS, HUMPHREY REDDICK and NOAH PERRY returned here to Court an allowance of a years provision made by them for the widow and children of FRANKLIN BUCK deceased...


This day ISAAC SAWYER Administrator of BENJAMIN SMITH deceased, returned here to Court an Inventory of the hire of the slaves and rents of the land of said Estate for the year 1850...


Ordered by the Court that ENOS JOHNSON be appointed overseer of the Jackson Road insted of E. M. TURNAGE removed...


Ordered by the Court that THOMAS DOKE, JOHN COOK, RICHARD L. CRAFTON, THEODRIC MINTON and GEORGE W. DICKEY be appointed a jury of view to review and mark out the nearest and best route for a Road from near R. L. CRAFTONS to Yorkville...


Ordered by the Court that SAMUEL NEELEY be appointed overseer of the Dresden Road from HENRY L. FOWLKES Gate to the Bridge of Lewis Creek instead of ELIAS P. LIGHT resigned...


Ordered by the Court that the Sheriff summon the following good and lawful men of the body of Dyer County to be and appear at the next term of the Circuit Court to be held at the Court House in the Town of Dyersburg in and for the said County, on the Second Monday in June next then and these to serve as a Venire? at said Court, towit;

Ordered by the Court that ANDERSON DICKEY be appointed overseer of the Road from THOMAS PACE's to Reed's Creek and that he have G. MITCHELL, DAVID BAIRD, JAMES SMITH, L. REED, ADEN REED, JAMES BLANKENSHIP, STEPHEN WITHERS, JAMES S. FERRELL & S. G. FERRELL to work on said road...
