Dyer County Court Clerk Minutes

Dated January 7, 1850


Be it Remembered that a County Court was begun and held at the Court House in the Town of Dyersburg for the County of Dyer, State of Tennessee, on the first Monday (it being the Seventh day) of January in the year of our Lord One Thousand Eight Hundred and fifty & in the Seventy-fourth year of American Independence.

Present and holding said Court the Worshipful THOMAS J. CONNELL Esquire Chairman, SAMUEL McDAVID and ALEXANDER B. STALLCUP Esquires quorum, JOSEPH N. PIERCE, JOHN F. SINCLAIR, HENRY WYNNE, BENJAMIN W. PERRY, SILAS FERRELL, HENRY WYNNE, SAMUEL WALKER, JOHN G. H. WILSON, HENRY P. STRAWN and JOHN WYNNE Esquires Justices of said Court (a majority of all the Justices), Zaccheus B. PHILLIPS Sheriff of said County AND JAMES H. DOYLE Clerk of said Court, when, after proclamation in due form, the following proceedings were had, viz:

On Motion an election was held for quorum Justices and chairman of the Court when THOMAS J. CONNELL, SAMUEL McDAVID and ALEXANDER B. STALLCUP were elected quorum Justices, of whom THOMAS J. CONNELL Esquire was elected Chairman.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

A majority of all the Justices of this Court being present and concurring therein, the Taxes for the year 1850 were levied at the following rates, towit: County Tax on each hundred dollars worth of Land, Slaves, Town Lots, Jewelry &c - Five cents; Bridge Tax on each $100, 5 cents; Pauper Tax four and one fourth cents, Jury Tax 4 1/4 cents, making in all 18 1/2 cents. On the privileges of selling Merchandise, Groceries, Drugs &c, and keeping Stud horses and Jacks one fourth the amount of the State Taxed, and on the privilege of Tippling Twenty dollars. And the County Tax on each White Poll 35 cents. And that the Clerk of this Court collect and account for the Taxes on Priviliges in the same manner that he is required to collect and account for the State Tax.

This day an election was held for an Entry Taker for Dyer County to fill the vacancy occasioned by the resignation of SAML. McDAVID instead of ROBERT D. BOGGUSS who had failed to give Bond and qualify, whereupon FRANCIS G. SAMPSON having received a majority of all the votes cast was declared duly elected.

A majority of all the Justices of this Court being present and a majority of those present concurring therein, an election was held for a Tax Collector of Dyer County, which resulted in the election of Zaccheus B. PHILLIPS to that office.

Ordered by the Court that JONATHAN D. SCOBY, WILLIAM J. SCOBY and HENRY P. STRAWN be appointed a Jury of view to examine and mark out an alteration in the Lake Road on HENRY REED's Land...

Issued 9th Jany 1850

On a motion to allow THOMAS J. CONNELL Esquire, Nineteen Dollars and fifty cents for Thirteen days services as quorum Justice of this Court in the year 1849. One Third of all the Justices of this court being present those voting for said allowance were Esquires McDAVID, STALLCUP, SINCLAIR, PERRY, PIERCE, HENRY WYNNE, STRAWN and WALKER. So said allowance was made and ordered to be paid by the County Trustee.

This day ALBERT G. FERGUSON and ABNER BENTON produced in open court here a settlement made with JOHN WYNNE Trustee of this County, which was received by the Court and ordered to be recorded.

DOYLE Clerk of this Court Twenty Dollars for his services in reference to Common Schools, Twelve Dollars and fifty cents for keeping Record Book, Revenue Book & Claim Book, Nine Dollars for recording and issuing eighteen Pauper orders, Six Dollars and Thirty eight cents for recording and issuing fifty one Road orders [goes on and on]...

On a motion to allow REBECCA REDDICK Forty Dollars for keeping her blind son a pauper for the year 1849. One Third of all the Justices of the Court being present. Those voting for said allowance were Esquires CONNELL, McDAVID, STALLCUP, SINCLAIR, PERRY, PIERCE, HENRY WYNNE, WALKER and STRAUN. So said allowance was made and ordered to be paid by the County Trustees.

Ordered by [the Court] that BENJAMIN W. PERRY furnish REDDING CAMPBELL a pauper of this County such provisions as he may need for the year 1850 and present his account to the next January term of this Court.

This day was produced here in open Court the nuncupative Will of JAHIEL M. McCORKLE deceased; Whereupon came R. A. H. McCORKLE and J. FRANCIS ALGEA who being first duly sworn depose and say that they were personally acquainted with the said JAHIEL M. McCORKLE the Testator in his lifetime, that he, being very near his dissolution and unable to write, requested them especially to bear witness to his last will and desire, that they believed the Testator to be in sound and disposing mind. It is therefore ordered by the Court that said will be received by the Court and set up as the Last will and Testament of JAHIEL M. McCORKLE deceased, and that it be recorded by the Clerk.
