Dyer County Court Clerk Minutes

Dated February 3, 1851


Be it Remembered that a County Court was begun and held for the County of Dyer State of Tennessee at the Court House in the Town of Dyersburg on the first Monday in Feby it being the third day of said month in the year of our Lord One Thousand Eight Hundred & fifty one & in the 75th year of American Independence.

Present and holding said Court the Worshipful SAMUEL McDAVID Esqr Chairman of said Court THOMAS J. CONNELL, JOSEPH N. PIERCE, H. N. JACKSON & HENRY WYNNE Esquires Justices of this court WILLIAM A. DAVIDSON Sheriff of said County & JAMES H. DOYLE Clerk of said Court when the following proceedings was had, towit:


Letters Issued 4th day of February AD 1851

Whereas the Last will and Testament of WILLIAM SMITH deceased late of this County has been duly proven & set up in this court, in which JAMES M. SMITH & TABITHA C. SMITH was appointed Executor & Executrix in conjunction with THOMAS H. FOWLKES, and whereas the said SMITHS has declined qualifying and waived their wrights of the Executorship in favour of THOMAS H. FOWLKES.

It is therefore ordered by the court that THOMAS H. FOWLKES be & he is hereby appointed Executor... with HENRY WYNNE, STEPHEN D. LIGHT, STEPHEN WOOD & GEORGE R. MULHEREN his securities...


Issued 3rd Feby 1851

Ordered by the Court that JAMES SHERRON, THOMAS KNIGHT, GASPER CHANDLER, JOHN W. HASSELL & REUBEN RAULES be & they are hereby appointed a Jury of view, to view & mark out an alteration in the Chesnut Bluff Road commencing at the RUTHERFORD old place...


Issued 3rd Feby 1851

Ordered by the Court that THOMAS H. FOWLKES, BOSTICK CHITWOOD, JAMES POWELL, SAMUEL BAKER, WILLIAM DEARMORE, M. O. R. GAULDING, WILLIAM H. LANIER, be and they are hereby appointed a Jury of view, to view & mark out a Establish & change a settlement & Mill Road... near R. HENDERSONS


This day WILLIAM S. SKIPWITH produced here in open court a commission from WILLIAM TROUSDALE Governor of this State of Tennessee appointing him a Justice of the peace for this county...


This day a settlement made by ROBERT JOHNSON Administrator of F. BEASLEY deceased with JAMES H. DOYLE Clerk of this court was produced in open court & in all things Confirmed by the Court & ordered of Record.


This day HENRY WYNNE was appointed administrator Debones? Non of the Estate of JNO. N. BESSANT deceased... with GEORGE R. MULHERIN his security...


Ordered Issued 4 Feby 1851

On the Petition of WILLIAM B. FIELDS it is ordered by the court that the Sheriff Summons EMANUEL TURNAGE to appear at the next Term of this Court & show cause if any he has or can why he should not be Ruled to give other security to his Bond for Bastardy in the Room & Stead of WILLIAM B. FIELDS one of his present securities.

Expartee Petition division of Slaves

Be it Remembered that on this the 3rd day of February A.D. 1851 Came on this petition of the Heirs of HUGH N. SHEARIN to be heard when it appeares to the Court that said HUGH N. SHEARIN departed this life in Dyer County Intestate, that the petitioners as tenants in Common are the parties? entitled to the Slaves described in said Petition as the distributees of the said HUGH N. SHEARIN decd.

It is therefore Ordered adjudged and decreed by the Court that HUGH N. JACKSON, REUBEN RAWLES, LEWIS WORRAN, BENJAMIN PERRY & THOMAS KNIGHT be appointed Commissioners to divide and allott said slaves to and among the petitioners in five Lots or Shares as prayed for in said petition...

Be it Remembered on this the 3rd day of February AD 1851 Came on this cause to be heard. Whereupon it is Considered by the Court that the said APPLEWHITE stands Convicted of being the Father of a bastard child begotton on the body of CAROLINE FARRELL.

Whereupon came the said APPLEWHITE in to open court together with D. J. WILLIAMSON and WM. A. DAWSON his securities and entered into and acknowledged bond in the penal sum of one hundred dollars Conditioned to pay said CAROLINE FERRELL, Thirty dollars for the year 1851, Twenty dollars for the year 1852, and was thereupon discharged.
