Last Will of C. L. POWELL Probated March 27, 1947 Last Will and Testament of C. L. POWELL I, C. L. POWELL, of Crockett County, Tennessee, being of sound mind and disposing memory, do hereby make and publish this my last will and testament. I. I direct that all my just debts debts shall be paid as soon after my death as possible; and if the debts due me, and the proceeds of the sale of my perishable property be insufficient for that purpose, my Executors, hereinafter named, are authorized to sell so much of my other estate, real and personal, as may be necessary to pay such debts. II. I give, devise, and bequeath, in equal parts, to my brothers, A. L. POWELL and D. H. POWELL, all my estate of every kind and character, both real and personal, wherever the same shall be located, as their absolute property to the exclusion of all other persons; provided that if only one of my said brothers shall survive me, then all of my estate of every kind and character, both real and personal, wherever located, I give, devise, and bequeath to such brother, as his absolute property to the exclusion of all other persons. III. I hereby nominate and appoint my said brothers, A. L. POWELL and D. H. POWELL, as join Executors of this my last will and testament, with full power and authority to execute the same according to its true and intended meaning, and having perfect confidence in their judgment and integrity, I direct that the said Executors shall not give any security or bond; provided that if only one of my said brothers shall survive me, then I nominate and appoint such brother as the Executor of this my last will and testament, and direct that he not be required to give any security or bond.
In testimony whereof, I have hereunto set my signature, this 22nd day of January, 1940 A.D.
