Will of J. E. CLARK

Minute Book 10

I, J. E. CLARK, being feeble in health but sound in mind, do make and publish this my last Will and Testament revoking and making void all others at any time by me made.

1st I direct that my funeral expenses together with all of my just debts to be paid out of any money I may die possessed of or may first come into the hands of my Executrix.

2nd I give and bequeath to my wife L. A. CLARK a certain Pollacy of One thousand dollars on my life and made payable to her by the Woodman Order: also my old family horse my brood mare and my pair of mules: all the cattle and hogs, the wagon and buggy harness and farming utensils of all kinds; and the corn hay and all the provisions of all kind on hand.

3rd I give and bequeath to my daughter FRED CLARK one third of all the money notes accounts belonging to my estate after the above named debts are paid to be paid to her when collected or the same may come into the hands of my Executrix.

4th I give and bequeath to my son VERNER CLARK one third of all of the money notes and accounts belonging to my estate after the above named debts are paid to be paid to him when he becomes twenty one years of age with the provision he is to have the interest that accumulate on the same and if it be necessary he may draw of the principal for the purpose of obtaining an education before he becomes twenty one years of age.

5th I give and bequeath to my son RUPERT L. CLARK one third of the money notes and accounts belonging to my estate after the above stated debts are paid to be paid to him when he becomes twenty one years of age also with the provision that the interest be paid to him and if necessary to his education he may draw of the principal for that purpose before he arrives at the age of 21 years.

6th I further give and bequeath to my wife L. A. CLARK the use and benefit of my home tract of land with all of the improvments thereon (To-wit) 50 acres in District No. 10 of Crockett County Tennessee, bounded on the North by H. R. BRANCH and the South by STALLINGS and SUTTON East by JODIE RIDDICK, West by Public road to have and to hold the same as long as she remains my widow, But in case she should marry her right thereto ceases; and my three children if living are to pay her one hundred dollars each in all three hundred dollars; or in case one or more of them be dead the one or ones living are to pay the full amount of $300. and she is to give up the farm to them.

7th Lastly I nominate and appoint my beloved wife L. A. CLARK my Executrix to this my will and knowing her as I do I have full confidence in her honesty and ability to discharge the duties herein desired and that she proceed upon my decease to take charge of the Estate and administer the same as directed without giving Bond or making oath.

In testimony wherof I affix my hand this the 15th day of Oct. 1913

To the Worshipful County Court of Crockett County Tennessee

We the undersigned children and only heirs at law of J. E. CLARK, deceased, hereby admit that the paper writing purporting to be the last will and testament of the said J. E. CLARK, bearing his true and genuine signature and dated the 15th day of October, 1913, is the last Will and Testament of our father, and that the entire paper consisting of two full pages and part of a third, is in his hand writing and we hereby request that said paper writing be admitted to probate as his last will and testament and that our mother who is named therein as Executrix be granted letters as such Executrix without bond as the will provides.

In witness whereof we hereunto set our hands this the 18th day of Sept. 1922
