WILLIAM STACY'S WILL

I William Stacy of the County of Carroll and State of Tennessee being of sound mind and memory and considering the uncertainty of this frail life do therefore make ordain publish and disclose this to be my last will and Testament.
(That is to say)  first after all my lawful debts & funeral expences are paid and discharged I desire an equal proportion of the proceeds of my Estate to go to my children Jacob Stacy Thomas Stacy Gincey Sherrill Huldy Horn Polly Allen and Louisa Roby except that I give and bequeath unto the hirs of the body of my deceased daughter Betsy Lorance one half of the amount that I give to each of the children above named all of the money which I may die possessed of I wish to be taken into possession by my Executors as soon as may be after my decease and as soon as may be thought practicable by my Executors after my decease.  I desire them to expose for sale to the highest bidder at the premises on which I now reside all of my real and personal estate on a credit of six months notes and approved security being taken and also a lien retained on my land (about seventy acres) for the purchase money of the same.
(The following exceptions is to be taken to the above requisitions)  all sales coming under five Dollars are to be cash.
When the proceeds of the sale shall be divided as also all other monies which may come into the hands of my Executors (either having been on hand or collected from persons now or at the time of my decease indebted to me)  I particularly will and desire that the portion of money going to my Daughters Gincey Sherrill & Louisa Roby be paid by my Executors into their own hands for their sole and seperate use, their husbands having nothing to do with the same.
In the settlement with Huldy Horn I desire a note which I now hold on her for about one hundred and twenty five dollars to be taken into consideration it being for money furnished out of my pocket a portion of which was silver, but it is my will and desire that no interest be collected on the same,  I also hold the note of James Roby the husband of my daughter Louisa for about forty Dollars with John Norman as security  I wish this to be collected and appropriated in the division, any notes or outstanding accounts which I may have against Jacob, Thomas Huldy Horn (with the exception of the hundred and twenty five dollars note)  Gincey Sherrill, Polly Allen & my daughter Louisa I do not wish taken into consideration on a settlement with my Executors I may come into their hands to pay them for the trouble what they may be at in settleing my business.
Before my effects shall be sold I wish a notice written of the sale to be given in Huntindon and such other places as may be thought proper fifteen days before the sale  I hereby make constitute and appoint Lucien L. Hawkins and my son Thomas W. Stacy to be Executors of this my last will and testament hereby revoking all former wills by me made  In witness whereof I have hereunto subscribed my name and affixed my seal the 23rd day of April in the year of our Lord One thousand eight hundred and sixty four.

The above written instrument was subscribed by the said William Stacy (By making his mark) in our presence and acknowledge by him to each of us, and he at the same time published and declared the above instrument so subscribed to be his last will and testament and we at the testators request and in his presence have signed our names as witnesses hereto

At the above term of said court the foregoing was probated as the last will & Testament of William Stacy Decd which was duly probated and ordered to be recorded  Of which the foregoing is a copy Test
