JOHN SHELLY'S WILL
In the name of God Amen
I John Shelby of the County of Carroll and State of Tennessee being of sound mind and memory do make and publish this as my last will and testament hereby revoking and making void all other wills made by me at any time.
1st I direct that my funeral expences and just and lawful debts that I may be oweing be paid as soon after my death as posible out of any monies that I may be possessed of or may first come in the hands of my Executors
2nd I direct that all my personal estate be sold
3rd I then make the following distribution of my estate which to me seemeth right
4th I give and bequeath to my daughter Elizabeth M. Hilliard the sum of one Dollar which shall constitute her portion of my Estate
5th I give and bequeath to my daughter Caroline Fleming the sum of one Dollar which shall constitute her portion of my Estate
6th I give and bequeath to the heirs of my daughter Polly H. Harper the sum of one Dollar which shall constitute their portion of my Estate
7th I give and bequeath to my son James T. Shelly the sum of one Dollar this shall constitute his portion of my Estate
8th I give and bequeath to my son John Shelly the sum of one Dollar this shall constitute his portion of my Estate
9th I give and bequeath to the heirs of my daughter Adalina Park the sum of one Dollar which shall constitute their portion of my Estate
10th I give and bequeath to Sarah Brown and Nancy J. Park all the rest
residue and remainder of my personal estate to be equally divided between them
of every description
11th and lastly I constitute and appoint my friends Willoughby Pugh and
William Nicholass my Executors to execute all titles of my lands and real estate
to them Witness whereof I do this my last and testament set my
hand and seal this the 6th day of March 1865
