I, WILLIAM MCKINNEY, of said state and county, being of
advanced age, but of sound and
disposing mind and memory knowing that I must shortly
depart this life deems it right and proper both as respects my
family and myself that I should make a disposition of the
property with which a kind providence has blessed me.
I do therefore make this my last will and testament
hereby revoking and annulling all others by me heretofore made.
First, I desire and decide that my body be buried in a
decent and Christian-like manner suitable to my circumstances
and condition in life. My soul, I trust shall return to rest with God, who gave it
as I hope, salvation through the merits and atonement of the
blessed Lord and Savior, Jesus Christ.
Secondly, I devise and de.... that all my just debts be
paid without delay by my executors hereinafter named and
appointed.
Thirdly, I give and bequeath and devise to my beloved
wife, MARY MCKINNEY, all the household and kitchen furniture to
her own use and ... and that at her disposal as she may deem
proper. Also one
cow and calf.
Furthermore, that she shall have ample support off of all
my land that all the children pay their proprioable part off the
land I bequeath to them for her support.
If they should fail to do so ... that my executors see
that the land is rented out for the purpose above mentioned on
or such as takes for her support.
Fourthly I give and bequeath to my son BALUS W MCKINNEY
the home place wherein I now live, part of lot # 101 in the
second district of originally Habersham, now White described in
a deed made to me by ANDREW DORSEY containing 162 1/2 acres more
or less. With the
following exception that if my beloved wife, MARY MCKINNEY
desires a home then she is to have the use of the house and
garden whereon I now live. On any lots for cultivation, she is to have the use and
benefits of the same, also she is to have any fruit out of the
orchard she may want.
Fifthly, I
give and bequeath to my beloved daughters, LOUISA ADALINE
BREWER, MARY E.F. BROWNLOW, AND REBECCA LOUVADA HOGAN, our lot
of land # 163 in the 2nd district originally Habersham, now
White County.
To my first daughter, LOUISA A. BREWER, the middle part
of the lot containing the house and orchard, Also to
my two other daughters, above named, have equal rights to
the fruit of the orchard and a right of way to and from.
Also to my daughter, MARY ELVIRA FRANCES BROWNLOW, 100
acres of land on the east part of said lot # 163 in said
district, a conditional line already established and agreed
upon. To my
daughter, REBECCA LOUVADA HOGAN, the west part of lot #163 in
said district. The
middle and west part to be equally divided between my two
daughters, LOUISA A. BREWER AND REBECCA L. HOGAN.
The title to be in each of my daughters as above named
and described as long as they shall live and then the title to
pass unto their children and the same shall no to be subject to
any debt of their present husbands or any future husbands or any
debt they may contract thus.
Also that my son BALUS W MCKINNEY in like manner shall
have full privileges to the land bequeathed to him.
The title to be in his name as long as he shall live and
then pass unto his children and not be subject to any debt he or
they may contract.
Sixth, I desire that all my personal property be sold and
equally divided at my death, except what I have given to my
beloved wife, MARY MCKINNEY, among my son BALUS W., LOUISA
ADALINE, MARY E.F. AND REBECCA LOUVADA.
Seventh, I hereby constitute and appoint my son BALUS W
MCKINNEY, and JEREMIAH BROWNLOW, executors of this my last will
and testament. This
November 14, 1882. Witnesses:
C.P. CRACY, H.A. JARRARD, ISAAC OAKES, ordinary.
Note
from submitter: Between
1850 and 1855 William McKinney
and his wife Mary Miller McKinney, along with their children,
left Pickens County SC for White Co. Ga. William was born
on Nov. 26, 1811 in SC. He died on May 4, 1887 in
White
County
. Mary Miller McKinney was born on Jan. 12, 1812 in SC;
the daughter of Isaac Miller Sr. and Hester Mayfield Miller.
Mary died on Nov. 16, 1887.
